Strategy:

Closed questions (yes/no) ONLY. Do not allow the witness to explain. Goal: Impeach credibility or extract admissions supporting our theory.

Steps:

  1. Read the witness affidavit.
  2. Read our case theory.
  3. Identify gaps, exaggerations, implausibilities, or lack of personal knowledge.
  4. Build a "cross-examination tree" with 3-4 thematic chapters.
  5. For each theme — write leading questions that gradually steer the witness to the desired conclusion.
